DUI

Arizona has some of the harshest DUI laws in the country. There is zero tolerance for driving impaired. Arizona makes it illegal to drive if impaired to the slightest degree. Domestic Violence

Domestic violence charges can be confusing because often times no violence occurred. Domestic violence is an allegation that is attached to the original offense, such as Interfering with Judicial Proceedings, Disorderly Conduct, and Assault. The domestic violence allegation is charged if the nature of the relationship with the alleged victim falls within the definition in the Arizona Revised Statutes.

Misdemeanor assault is committed in Arizona when a person intentionally, knowingly or recklessly causes any physical injury to another person, intentionally places another person in reasonable apprehension of imminent physical injury, or knowingly touches another person with the intent to injure, insult or provoke such person. Misdemeanor classifications

  • Class 1 misdemeanors are punishable by up to a maximum of 6 months of jail, a $2,500 fine plus surcharge, and up to 3 years of probation.
  • Class 2 misdemeanors are punishable by up to a maximum of 4 months of jail, a $750 fine plus surcharge, and up to 2 years of probation.
  • Class 3 misdemeanors are punishable by up to a maximum of 30 days in jail, a $500 fine plus surcharge, and up to 12 months of probation.

Common questions

How much does a criminal defense attorney cost in Phoenix?

The Talcott Law Firm offers a free initial consultation, and you will know the fee before you decide to hire us. Fees depend on the charge, the court, and the stage and complexity of the case — a first-offense misdemeanor and a felony headed for trial are very different engagements.

Should I talk to the police before speaking with a lawyer?

No. You have the right to remain silent, and polite silence cannot be used against you the way an explanation can. Give your identifying information, ask for a lawyer, and say nothing about the facts until you have one — even if you are innocent.

What is the difference between a misdemeanor and a felony in Arizona?

Misdemeanors come in three classes; a class 1 misdemeanor carries up to six months in jail and a fine of up to $2,500 plus surcharges. Felonies come in six classes and carry possible prison time, and a felony conviction affects civil rights, employment, and housing long after the sentence ends.

Can criminal charges be dismissed or reduced?

Often that is the realistic goal. Depending on the case, outcomes can include outright dismissal, diversion programs that end without a conviction, or reduction to a lesser offense. What is achievable depends on the evidence, your history, and how early a defense attorney gets involved — no honest lawyer promises a result.
